Terms of Service

These Terms of Service ("Terms") govern your access to and use of the REWIND mobile application and any related services (collectively, the "Service"), operated by the REWIND team ("we", "us", or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. ELIGIBILITY
You must be at least 14 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you meet this requirement. If you are under 18 years of age, you confirm that you have obtained the consent of a parent or legal guardian to use the Service. If you are located in a country where the minimum age for digital consent is higher than 14, that higher age applies to you.
We reserve the right to refuse access to any person at our discretion, including where we have reason to believe that eligibility requirements have not been met.
2. ACCOUNTS AND ACCESS
To use REWIND, you must create an account by providing a valid email address (or by using a supported third-party authentication provider) and choosing a username. You must provide accurate and complete information during registration. We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at privacy@rewindapp.it if you become aware of any unauthorised use of your account.
You may not create more than one account per person, impersonate another individual, or register on behalf of someone else without their explicit consent.
3. THE SERVICE
REWIND is a social photography application built around the concept of time-delayed photo development. A number of core mechanics are fundamental to how the Service operates:
- Photo development — photos captured through the in-app camera are held in a digital darkroom and developed on a scheduled basis (typically at 9:00 AM daily). Once developed, photos become visible to the relevant recipients. This mechanic is integral to the Service and cannot be bypassed or circumvented.
- No previews — photos cannot be previewed, edited, filtered externally, or deleted before development. This is a deliberate design constraint of the Service.
- Photo expiry — undeveloped or unsaved photos are permanently deleted after 30 days from their development date, unless explicitly saved to your archive. We are not liable for any loss of content resulting from expiry.
- Group darkrooms — users may participate in shared group experiences where multiple participants contribute photos to a common darkroom, subject to the same development mechanics.
We provide the Service on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or available at all times. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you.
4. USER CONTENT
You retain full ownership of all photos and content you create and upload through the Service ("User Content"). We do not claim any ownership rights over your User Content.
By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, process, and transmit your User Content solely to the extent necessary to provide the Service — for example, to display your photos to friends or group members you have chosen to share with, and to apply the photo development process.
This licence terminates automatically when you delete the relevant content or your account. We will never use your photos for advertising, sell them to third parties, or use them for any purpose beyond operating the Service.
You are solely responsible for the User Content you share. By posting content, you represent and warrant that: (a) you own or have the necessary rights to share the content; (b) the content does not infringe any third-party intellectual property, privacy, or other rights; and (c) the content complies with these Terms and applicable law.
5. PROHIBITED CONDUCT AND ZERO TOLERANCE
REWIND has zero tolerance for objectionable content and abusive users. Any user who posts objectionable content or engages in abusive behavior toward other users will have their content removed immediately and their account permanently terminated. We review all reports within 24 hours of submission. Users may report any photo or other user directly within the app, and may also block any user to prevent further interaction.
You agree not to use the Service to:
- Upload, share, or distribute any content that is unlawful, obscene, defamatory, threatening, harassing, hateful, or otherwise objectionable.
- Upload, share, or distribute any content that sexually exploits, endangers, or abuses minors. Any such content will be reported to the relevant authorities and will result in immediate account termination.
- Harass, threaten, intimidate, bully, or stalk other users.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to the Service, other user accounts, or our underlying infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated tools, bots, or scrapers to access or extract data from the Service without our express written permission.
- Use the Service for any commercial purpose without our prior written consent.
- Violate any applicable local, national, or international law or regulation.
We reserve the right to remove any User Content that violates these Terms and to suspend or permanently terminate the accounts of users who engage in prohibited conduct, without notice or liability.
6. INTELLECTUAL PROPERTY
All elements of the Service — including the application design, user interface, graphics, logos, and underlying technology — are owned by or licensed to us and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other brand assets without our prior written consent.
7. PRIVACY
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of your information as described therein.
8. TERMINATION
You may terminate your account and stop using the Service at any time by navigating to Settings → Delete Account within the app. Upon termination, your data will be deleted in accordance with our Privacy Policy.
We may suspend or permanently terminate your access to the Service at our sole discretion, including where we reasonably believe you have violated these Terms, where required by law, or where we decide to discontinue the Service. We will endeavour to provide reasonable notice where possible, but are not obliged to do so.
9. DISCLAIMERS
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or that it will be available on an uninterrupted, secure, or error-free basis.
We are not responsible for any content posted by users of the Service, nor for any loss or damage arising from your reliance on such content.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Service, including but not limited to loss of data, loss of photos, loss of revenue, or loss of goodwill, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to us in the twelve months preceding the claim. As REWIND is currently provided free of charge, this amount is zero in most cases.
Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full.
11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rome, Italy, unless mandatory consumer protection laws in your country of residence provide otherwise.
12. CHANGES TO THESE TERMS
We may revise these Terms from time to time. When we make material changes, we will notify you through the app or by email prior to the changes taking effect. Your continued use of the Service following such notification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
